Terms of Service

These Terms of Service ("Terms") govern your use of the LUNA AI Art Generator mobile application ("LUNA" or the "App") and our website at aiartluna.com (the "Website"), operated by Rocket Digital Limited ("we," "our," or "us").

By downloading, installing, or using LUNA, you agree to be bound by these Terms. If you do not agree, please do not use the App or Website.

1. Eligibility

You must be at least 13 years of age to use LUNA. If you are under 18, you must have the consent of a parent or legal guardian to use the App. By using LUNA, you represent and warrant that you meet these requirements.

2. Account Registration

Some features of LUNA require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.

3. Use of the Service

3.1 Permitted Use

LUNA grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal and, with LUNA Premium, commercial purposes, subject to these Terms.

3.2 Prohibited Use

You agree not to use LUNA to:

• Generate illegal, harmful, harassing, defamatory, or obscene content
• Create deepfakes or misleading content intended to deceive others
• Infringe upon the intellectual property rights of others
• Attempt to reverse engineer, decompile, or hack the App
• Violate any applicable laws or regulations
• Generate content that exploits or harms minors in any way
• Use automated systems or bots to access the service
• Resell or redistribute the App or its services without authorization

4. AI-Generated Content

4.1 Content Ownership

Free Users: You retain personal-use rights to AI-generated content created with the free version of LUNA. Commercial use of free-tier content is not permitted without upgrading to LUNA Premium.

LUNA Premium Users: You own the commercial rights to AI-generated content you create. You may use, modify, sell, and distribute this content freely, subject to applicable laws.

4.2 Content Guidelines

We reserve the right to remove any content that violates these Terms or our community guidelines. AI-generated content may be subject to automated content moderation.

4.3 AI Limitations

AI-generated images may occasionally produce unexpected or inaccurate results. We do not guarantee the accuracy, quality, or suitability of any AI-generated content.

5. Third-Party Services

LUNA integrates with the following third-party services to provide its features:

• Firebase (Google LLC): Authentication, cloud storage, crash reporting, and analytics
• RevenueCat: Subscription and payment management
• Google AdMob: Advertisement display in the free version
• OpenAI: AI model processing for image generation
• Microsoft Azure: Cloud computing and image processing
• Replicate: AI model inference for image generation
• Fal.ai: AI model inference for image generation
• Google Analytics: Website analytics and usage tracking
• Meta Pixel: Website advertising measurement

Your use of LUNA is also subject to the terms and privacy policies of these third-party services. We are not responsible for the practices of these services.

6. Subscriptions and Payments

6.1 LUNA Premium

LUNA offers premium subscription plans that provide additional features, including unlimited generations, 4K upscaling, and commercial usage rights. Subscription details and pricing are available within the App.

6.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your platform. Payment processing is handled by RevenueCat and the respective app store.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your app store settings. Cancellation takes effect at the end of the current billing period. Refund requests are subject to the policies of the Apple App Store or Google Play Store.

7. Intellectual Property

The LUNA app, including its design, features, code, and AI models, is the intellectual property of Rocket Digital Limited. You may not copy, modify, or distribute any part of the App without our written consent.

8. Disclaimer of Warranties

LUNA is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of LUNA, regardless of the cause of action.

10. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or your violation of these Terms.

11. Termination

We may suspend or terminate your access to LUNA at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
